You can no longer register these exemptions for new sites. However, if you currently hold one of these exemptions you will have between 18 months and three-and-a-half years to transfer to the new system.
How long you have to transfer to the new system will depend on which exemption you currently hold. Please check the table below for details:
NEW 1 October 2011 transition
Customers who have currently registered Paragraphs 9, 10, 12 or 19 and cannot comply with one of the new exemptions will need to apply for a permit by the 1 October 2011. Please read this page for more information about the October transition:
All of these complex exemptions, with the exception of Paragraph 12, need to be renewed every 12 months. If you want to continue to benefit from the transitional provisions you will have to renew these exemptions.
You do not have to renew the paragraph 12 exemption to benefit from the transitional provisions.
In order to benefit from the transitional provisions you must comply with the requirements of the existing exemption. If you breach the exemption you will lose your transitional status.
The transitional provisions only apply to existing sites. You cannot register any new sites under the old system at this stage.
When renewing the exemption you will not be able to vary it, for example by changing or adding new waste streams. If you want to do this you will need to move into the new system and may need either a new exemption or a permit, depending on what you want to do:
Renewing your complex exemption
You will need to advise us that you wish to renew your exemption and fill out a form that is specific to that exemption. You do not have to renew a paragraph 12 exemption.
With the exception of paragraph 12, the complex exemptions are:
- chargeable, and
- subject to annual renewal and the payment of an annual fee.

In most cases any establishment, or undertaking, which registers a complex exemption with us must:
- be the occupier of the land where it will be undertaken, or
- have the consent of the land owner.
