Different exemptions need different levels of information depending on the level of risk the activity poses.
You cannot register any new waste operations under these exemptions. This old waste exemptions system has been replaced by a new waste exemptions system.
Customers who have currently registered Paragraphs 9, 10, 12 or 19 and cannot comply with one of the new exemptions will need to apply for a permit by the 1 October 2011. Please read this page for more information about the October transition:
To find out about the new exemptions and how to register them,
Under the old system exemptions were known as simple or complex and you can find guidance on them below. You can also renew any complex exemptions that have a twelve month expiry period and which are due to expire.
If you are carrying out exempt waste operations which held a valid registration on 5 April 2010 you can continue to operate under them until the transition date for that exemption is reached. You must still comply with the terms and conditions of those exemptions until you move over into the new system and renew if that is a requirement of your registration:
Not all old exemptions have mapped across to new ones. You will have to check the new terms and conditions carefully to see if you can still carry out your activity under an exemption. Some activities are no longer exempt and you will be required to get an environmental permit. New standard rules permits have been provided to replace some complex exemptions.
Simple and complex exemptions
Different exemptions need different levels of information depending on the level of risk the activity poses.
- Simple exemptions
These are for information only you cannot make any new applications for any of these exemptions.
- Complex exemptions
If you have a valid registration on the 5 April 2010, you can still renew your complex exemptions but you cannot make any new registrations. You can continue to renew these complex exemptions until the transitional deadline date is reached by which time your operation must have either ceased or must have applied for an environmental permit under the new legislation.
