What Paragraph 46 exemption permits

Paragraph 46 allows:

  • imported plant tissue and wooden packaging waste to be burnt at the docks if the burn has also been sanctioned under the Plant Health Order 1993
  • the storage of plant tissue and wood waste prior to burning.

The exemption limits the:

  • volume of plant tissue and wood waste that can be stored and burnt each day to no more than 15 tonnes, and
  • burn to the docks if the dunnage was landed at a place where it is secured and contained.

Paragraph 46 is one of the higher risk exemptions. As such, before we register this exemption on your behalf you need to complete a form and provide us with information in support of your proposal. The exemption:

  • is chargeable
  • requires annual renewal, and
  • a payment each year, of a renewal fee.

Q. Does the registration, which lasts 12 months, cover repeated burnings during that period?
A Yes, it does allow for repeated burnings provided that the accumulated volume does not exceed 15 tonnes over a 24 hour period.

Q. Will a shipping company who is sanctioned to burn waste under the Plant Health Order 1993, but does not have the landowner's consent, still qualify for this exemption.
A. No, you must have the landowner's consent.
