Many of the directive's requirements apply to producers of new vehicles. Producers are businesses that manufacture or import new motor vehicles.
It also applies to operators of sites that receive or treat ELVs known as Authorised Treatment Facilities (ATF).
What do I need to do?
Producers are required to provide information on how best to treat and recycle their vehicles. They also need to restrict the use of certain hazardous substances when manufacturing new vehicles.
Since the introduction of the ELV regulations in 2003, site operators now require an environmental permit to treat or keep ELVs that have not been ‘depolluted’ – treated to remove fluids and other hazardous substances and components.
The Paragraph 45 waste exemption from environmental permitting can only accept or dismantle vehicles that have already been depolluted. Please note: No new applications for a Paragraph 45 exemption can be made as new regulations that were introduced in April 2010 removed this exemption.

If you wish to start a new operation dismantling depolluted vehicles you are now likely to need an environmental permit. Operators who already have a Paragraph 45 exemption registered will have until 1 October 2013 to apply for an environmental permit.
There are some standard permits available if your operation meets all the location restrictions and limits of the standard rules.
