The regulations apply to all waste incineration and co-incineration plants in Scotland except those defined as an ‘excluded plant’ within the regulations.
New waste incineration installations must comply with the regulations before they begin operation.
What do you have to do?
If you operate a waste incineration installation you must apply for a permit. If you already had an authorisation or permit before the regulations came into force, you need to apply for a variation on your authorisation.
A request to change your authorisation should be sent to the Scottish Environment Protection Agency (SEPA).
Who enforces the Waste Incineration (Scotland) Regulations?
SEPA enforces the regulations.
If you fail to comply with the legislation you could be prosecuted and fined.
