Agricultural premises and the Hazardous Waste Regulations 2005

The interim position for hazardous waste produced at agricultural premises was adopted as part of the amended Hazardous Waste Regulations on 6 April 2009.

This means you can continue to benefit from being exempt from needing to register as a hazardous waste producer if you meet the following conditions:

  1. You produce less than 500kg of agricultural hazardous waste per year;
  2. Hazardous waste removed is transported by either a registered waste carrier or a carrier that is exempt from the need to be a registered carrier;
  3. Consignment notes are completed for (and accompany) removal of hazardous waste.

If more than 500kg of hazardous waste is produced, the premises must be registered.

For agricultural premises only we will not count the weight of end of life vehicles (scrap vehicles) as counting towards the 500kg threshold.
