We have previously provided a position on the use of small quantities of road planings on tracks and roads, without the need to register a Paragraph 19 exemption.
The waste exemptions regime was revised in April 2010 and the Paragraph 19 exemption was replaced with a new exemption U1 (Use of waste in construction), for the use of small quantities of waste in construction. There is no charge to register a U1 exemption to use road planings for constructing and maintaining agricultural tracks and roads, or for other types of activities, providing the conditions of the exemption are met.
However, we have extended our regulatory position because the changes to agricultural exemptions do not take effect until October 2013. We do not believe that farmers who relied on the regulatory position should have to register exemptions earlier simply to continue using small quantities of road planings.
